1. Introduction

These terms and conditions govern the use of the Theatre Prompter application and related web services. By creating an account and using our software you agree to these terms. The provider is KVK Media s.r.o., Ruská 48, Prague 10, 101 00, Czech Republic, Company No. 48034991.

2. Software provided "AS IS"

The Theatre Prompter application is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied by law.

The provider (developer) does not warrant that the application will meet your specific theatre production requirements, that it will always operate uninterrupted, timely, securely or entirely error-free, or that software defects will always be fixed immediately.

3. Limitation of Liability

The developer (provider) shall in no event be liable for any direct, indirect, incidental, special or consequential damages arising from the use of, or inability to use, this software.

• The provider accepts no liability for hardware or software failure during a live theatre performance (live show).
• The provider is not liable for loss of data (scripts, cue points), the theatre's lost profit, interrupted rehearsals or any loss of reputation.
• The Theatre Prompter application should never be the only system (a "Single Point of Failure") critical to the safe running or successful completion of a commercial theatre performance without a backup plan. Use of the application during a production is solely at the organisation's (theatre's) own risk.

4. Data ownership and privacy

All rights to texts, plays and scripts loaded into the Theatre Prompter application remain with the user (the theatre). The provider makes no claim to works uploaded by users, and undertakes that collected data about theatres and payments will not be sold to third parties and will be protected in accordance with the GDPR. 5. Final provisions

We reserve the right to update or amend these terms at any time. Significant changes will be communicated to your registration e-mail.
